GOVERNOR'S PROPOSED BUDGET FOR FY 2010-11
Governor Rell's proposed budget revisions for the second year of the biennium. The bill would maintain funding for most municipal aid programs but would make cuts in several areas, including school transportation and the manufacturer's PILOT program.
HB05020 - AN ACT IMPLEMENTING THE BUDGET RECOMMENDATIONS OF THE GOVERNOR CONCERNING EDUCATION.Send Mail
GOVERNOR'S EDUCATION BILL
Among other things, would (1) reduce funding to magnet schools operated by regional education service centers and (2) change the grant funding to local and regional boards of education for meeting nutrition standards to “within available appropriations.”

GOVERNOR's MANDATE RELIEF PROPOSAL
Would, among other things: (1) enact a statutory prohibition against new unfunded mandates without a 2/3 vote of both chambers of the General Assembly; (2) permit municipalities to post certain legal notices on-line rather than in newspapers; (3) remove the mandate that municipalities collect and store the possessions of evicted tenants; and, (4) allow the creation a "MERF C" benefits plan for municipal savings.

EXPEDITED PERMITTING FOR ECONOMIC DEVELOPMENT
CCM has long advocated requiring “economic development teams” to be established for projects with permitting requirements in multiple state agencies – namely Department of Economic and Community Development, Department of Environmental Protection and Department of Transportation.


This bill would build on PA 09-165, which requires each regional planning organization to establish a voluntary process for applicants to state or local agencies, departments, or commissions to request a pre-application review of proposed projects of regional significance. Further, the Act requires the process to include a procedure to assure that all relevant municipalities and regional and state agencies provide the applicant with (1) preliminary comment on the project, in a form determined by the agency; (2) summaries of each agency's review process; and (3) an opportunity for the applicant to discuss the project with representatives of each relevant municipality or state agency at a meeting convened by the RPO.
HB05240 - AN ACT CONCERNING AFFORDABLE HOUSING DEVELOPMENTS IN ENVIRONMENTALLY REGULATED AREAS.Send Mail
ENVIRONMENTALLY SENSITIVE LANDS
Would provide an exemption from the Affordable Housing Land Use Appeals Act (CGS Section 8-30g) for areas of land where local, state or federal regulations - intended to protect the natural environment or natural resources – prohibit or substantially limit any development.

The Act, which was adopted in 1989, placed the burden of proof on municipal commissions to show that the denial or required modification of an affordable housing application should be upheld by the Courts. This has placed a sometimes insurmountable obstacle to protecting certain lands from development.

Passage of this proposal would, at the very least, ensure that environmentally sensitive lands continue to be protected.

Would create a $10 million revenue loss for municipalities by eliminating the real estate conveyance tax on foreclosures.
HB05424 - AN ACT PERMITTING TWO OR MORE BOARDS OF EDUCATION TO JOINTLY PURCHASE EMPLOYEE HEALTH INSURANCE.Send Mail

Would allow local and regional boards of education to join together for the purpose of procuring health insurance for their employees.
HB05425 - AN ACT CONCERNING SPECIAL EDUCATION.Send Mail
SPECIAL EDUCATION
Among other things,would (1) align the “Burden of Proof” requirement in Connecticut with the federal government by placing the onus on the party requesting the hearing; (2) create a new unfunded mandate on local governments by requiring behavior analyses and certain services for students with autism spectrum disorder; (3) specifies the qualifications of the individuals who would be administering the analysis and services; (4) requires boards of education to continue to pay for special education costs for students that have moved out of their districts.

Would allow RPOs to impose a regional sales tax, collected and administered by the State, to be used for "capital expenditures, distribution to municipalities, or any regular or special purpose" in the RPOs' budgets.

GOVERNOR'S BOND PROPOSALS
Governor's bonding proposals. Includes her proposal for $10 million fund for multi-municipal capitol purchases, for 75% of the cost up to $250,000 (section 9).

It would also repeal numerous bond authorizations.
SB00365 - AN ACT CONCERNING THE POSTING OF PUBLIC AGENCY MINUTES AND LEGAL NOTICES ON THE INTERNET WEB SITE OF A MUNICIPALITY.Send Mail

Would (1) clarify requirements imposed by PA 08-03 of the June Special Session, and (2) provide municipalities – who are in compliance with PA 08-03 of the June Special Session – the option of posting their mandated legal notices on their websites in lieu of placing costly ads in newspapers.

Would make permanent the present rates of the municipal real estate conveyance tax, now scheduled to sunset on 6/30/10.

LOCAL OPTION TAXES AND FEES
Would allow municipalities to (1) levy, by ordinance, any type of tax, including taxes on sales, food & beverages, amusements, hotels, payroll and hospital beds, and (2) impose a surcharge on any fee set by statute up to the cost to the municipality of providing a service.
